Guest Rental Agreement & Indemnity Form Property: Bos Loerie Bird 3832, Marloth Park, Nkomazi, RSA. Capacity: Maximum 8 Guests. 1. Rental Agreement & Occupancy By proceeding with this booking, I, the undersigned (hereafter referred to as "the Guest"), agree to the rental of the aforementioned property for recreational/vacation purposes only. Occupancy: The stay is strictly limited to the number of adults and children specified in the booking request. Parking: Off-street parking is provided for one (1) vehicle only. Right of Admission: Management reserves the full right of admission. Any legal and reasonable exercise of this right shall not result in liability for the Owner. 2. General Indemnity & Liability Personal Risk: While the Owner takes every precaution to ensure guest safety, all guests and their visitors enter and use the premises entirely at their own risk. Loss or Damage: The Owner, its agents, and employees accept no liability for any loss, damage, injury, or death sustained by guests or their visitors, regardless of the cause. Valuables: It is the Guest’s sole responsibility to ensure adequate insurance coverage for all valuables, including but not limited to electronics, jewelry, cash, and vehicles. Natural Events: The Owner is not liable for damages resulting from natural disasters or utility service interruptions (e.g., Eskom load shedding or power fluctuations). 3. Facilities & Safety Swimming Pool: There are no lifesaving facilities provided. Use of the pool and surrounding area is at the Guest's own risk. The Guest indemnifies the Owner against any claims arising from injury, drowning, or loss of property related to the pool. Wild Animals: Marloth Park is a wildlife area. Feeding animals is strictly prohibited. The Owner accepts no responsibility for injuries caused by wildlife. Minors: Parents or legal guardians assume full responsibility for the safety and conduct of minors at all times. 4. House Rules & Marloth Park Bylaws Failure to adhere to these rules may result in immediate eviction without a refund and/or deductions from the key deposit. Noise (Strict): In accordance with Marloth Park Bylaws, no music or excessive noise/shouting is permitted. A first complaint results in a warning; a second complaint will result in a final warning; a third complaint will result in immediate eviction. Pets: No pets are allowed within Marloth Park. Smoking: The house is a strictly non-smoking establishment. Smoking is permitted in designated outdoor areas only. Waste Management: All household refuse and braai ashes must be disposed of at the designated dumping site (Olifant Street, near Bush Centre). Do not leave rubbish outside the unit. Security: Windows and doors must be closed when leaving the house to prevent damage by baboons/monkeys. The alarm system must be armed whenever the property is vacant. Alarm Operation: One beep (Activated); Two beeps (Deactivated). Red button is for emergencies only. Accidental activations must be reported to the Security Company immediately. 5. Reservations, Cancellations & Payments Deposit: A 50% deposit is required to finalize the reservation. Final Payment: The remaining balance must be paid in full at least two (2) weeks prior to arrival. Cancellations: * Cancellations made 14 days or more before arrival: 100% of the total amount paid will be refunded. Cancellations made within 7 days of arrival: 50% of the total amount paid will be refunded. Refunds will be made within 5 working days after departure. Early departures are non-refundable. 6. Refundable Key & Breakage Deposit A refundable deposit of R 950.00 is required. This deposit will be refunded within [Insert Number] days of departure, provided the house is left in the same condition as received. Utilities & Guest Requirements Aircon (Prepaid): An initial R 50.00 credit is provided. Guests are responsible for purchasing further top-ups (Meter No: 54220581562) available at Spar, Pick n Pay, or via banking apps. Wi-Fi: No Wi-Fi is provided. Guest to Provide: Swimming/bath towels, black garbage bags, toilet paper, portable lighting for power outages, and personal sanitizers/masks.
